Rental terms

Last updated: October 2026 These rental terms apply to bookings made directly with us via azur-eternel.com, by email or by phone. Bookings via Airbnb or Traum-Ferienwohnungen are subject to the terms of the respective platform. 1. Landlord The landlord is Alwin Ehrensperger (see the legal notice for contact details), hereinafter "we". The homes are rented privately. 2. Enquiry and conclusion of contract Your enquiry via the website is non-binding. No dates are reserved and no payment is taken. In response to your enquiry, we send you a personal offer with the total price. The rental contract is concluded when you accept the offer and we confirm the booking by email. There is no statutory right of withdrawal for the rental of holiday accommodation for a specific period. For flexibility, the cancellation terms in section 9 apply. 3. Prices and services The total price stated in your offer or booking confirmation applies. Unless stated otherwise in the offer, it includes the rent for the agreed number of guests, final cleaning, and electricity, water and gas at normal consumption. Where a tourist tax (taxe de séjour) applies by law (e.g. in Menton), it is charged in addition and paid by us to the municipality. 4. Payment A deposit of 30% of the rental price is due on booking. The exact amount is stated in your booking confirmation. We agree the method and date of the balance payment with you individually and record them in the booking confirmation. The deposit is paid by bank transfer to the account stated in the booking confirmation. If the deposit is not received despite a reminder, we may withdraw from the contract. 5. Security deposit A security deposit is charged for some homes, for example €500 for Bungalow Palmitita. The amount and method of payment are stated in the offer. We refund the security deposit no later than 14 days after departure, less any costs for damage or exceptional cleaning, which we will explain to you. 6. Arrival and departure The home is available from 4 pm on the day of arrival and must be vacated by 10 am on the day of departure. Other times are possible by arrangement. You will receive the exact address and key handover details with the booking confirmation or before arrival. 7. Occupancy and registration The home may only be used by the persons stated in the booking and up to the stated maximum number of guests. Subletting is not permitted. Landlords in Spain and France must record guest data and report it to the authorities. Please send us the required details from your identity documents before arrival or present the documents on arrival. 8. Guest obligations - Please treat the home and its contents with care and observe the house rules on site and the quiet hours in the neighbourhood. - Smoking is not permitted indoors. - Pets are only allowed with our prior consent in writing (email is sufficient). An additional charge may apply. - Please report any damage or defects to us immediately so that we can remedy them. You are liable for damage culpably caused by you or your fellow travellers. - Use of the pool and outdoor areas is at your own risk. Children must be supervised at all times. 9. Cancellation by the guest You can cancel your booking by email at any time before the start of your stay. In this case we credit the deposit you have paid as a voucher towards a new direct booking with Azur Éternel. The credit is valid until the end of the calendar year following the cancellation. The credit cannot be paid out. We refund any amounts already paid in excess of the deposit. We recommend taking out travel cancellation insurance. 10. Cancellation by the landlord If we cannot provide the home for reasons beyond our control (for example force majeure or unforeseeable serious damage), we will inform you immediately and refund all payments made in full. Further claims exist only in accordance with section 11. 11. Liability We are liable without limitation for intent and gross negligence and for injury to life, body or health. Otherwise, we are only liable for breaches of essential contractual obligations, limited to the foreseeable, typical damage. We accept no liability for temporary interruptions of utilities (e.g. electricity, water, internet), construction noise in the area or disturbances caused by third parties beyond our control. 12. Final provisions Amendments and side agreements must be made in text form (e.g. email). German law applies, unless mandatory provisions of the country in which you are habitually resident provide otherwise. If any provision is invalid, the validity of the remaining provisions remains unaffected. The German version of these rental terms is legally binding.
