2. Summary
- We do not use analytics or advertising tools, tracking cookies or social media plugins, so there is no cookie banner.
- We only use the data you send us with an enquiry to answer it and to handle your stay.
- The website and email run on our own server in Germany.
- We do not sell your data and only pass it on where this is necessary for your stay or required by law.
3. Hosting and server logs
The website and our email server run on a server provided by netcup GmbH, Emmy-Noether-Straße 10, 76131 Karlsruhe, Germany. We have a data processing agreement with netcup under Art. 28 GDPR.
When you visit the website, the server processes technically necessary data: IP address, date and time, the address requested, the amount of data transferred, and browser and operating system details. We need this data to deliver the website, keep it secure and prevent misuse. Technical logs are only stored briefly and are regularly overwritten. The legal basis is our legitimate interest in secure and reliable operation (Art. 6(1)(f) GDPR).
The connection to the website is encrypted with TLS (HTTPS).
4. Enquiry form and contact by email
When you contact us via the enquiry form or by email, we process the details you provide: name, email address, preferred home, travel dates, number of guests and your message. You automatically receive an email confirming that we have received your enquiry.
To protect against spam, the form contains an invisible field, and the server limits the number of enquiries per IP address. For this purpose the IP address is only held in memory for about ten minutes and is not stored permanently.
The legal basis is taking steps at your request prior to entering into a contract (Art. 6(1)(b) GDPR). We delete enquiries that do not lead to a booking no later than two years after our last contact.
5. Booking and stay
To handle your booking, we also process the data required for the contract, payment and your stay, for example your address, payments received and arrangements for your arrival. The legal basis is the performance of a contract (Art. 6(1)(b) GDPR).
Disclosure to third parties:
- Housekeeping and cleaning staff on site receive the dates of your stay and the number of guests, but not your name or contact details, so that they can prepare the home.
- Registration obligations: in Spain and France, landlords of holiday homes are required to record certain guest data and report it to the competent authorities (in Spain, among others, under Real Decreto 933/2021). For this we need details from your identity document before or on arrival. The legal basis is compliance with a legal obligation (Art. 6(1)(c) GDPR).
- Banks and payment service providers process the details of your payments.
- Tourist tax: where a tourist tax applies (e.g. in Menton), we pay it to the municipality with the details required by law.
We keep contract and booking records for as long as statutory retention obligations apply, in particular under tax law (usually up to ten years). After that they are deleted.
6. Calendar synchronisation with booking platforms
Our homes are also offered on Airbnb and Traum-Ferienwohnungen. To avoid double bookings, we synchronise the occupancy calendars automatically. Only booked periods are transferred, no names or contact details. The website only shows whether a day is available or booked.
7. Guestbook and reviews
After a stay, guests can write in the guestbook using a personal invitation link. We only publish the name and text provided after review. You can have an entry removed at any time. The legal basis is your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time.
We show reviews from Airbnb and Traum-Ferienwohnungen with their source, date and the first name publicly shown there.
8. Maps (OpenStreetMap)
On the pages of our homes we show the approximate location on a map from OpenStreetMap. The map is loaded directly from the servers of the OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom. In the process, your IP address and technical details of your browser are transmitted to OpenStreetMap. The European Commission has adopted an adequacy decision for the United Kingdom. 9. Cookies and browser storage
The website does not set any cookies for visitors. Your language choice (German/English) is saved in your browser's storage (local storage) so that the site appears in your language on your next visit. This information does not leave your device. We only use a technically necessary session cookie for signing in to the administration area. The legal basis is Section 25 (2) no. 2 of the German TDDDG.
10. Your rights
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21 GDPR). You can withdraw any consent you have given at any time with effect for the future. An email to info@azur-eternel.com is sufficient.
You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the member state of your habitual residence, place of work or the place of the alleged infringement.
11. Obligation to provide data
For an enquiry we need your name, email address and travel dates; for a booking we also need the details required by contract and by law. Without these details we cannot process your enquiry or booking. No automated decision-making takes place.
